Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Volna ("we" or "our") concerning your access to and use of the website https://officialvolna.com/ (the "Site") and any related services provided by us (collectively, the "Services").

Order Modifications and Cancellations

You may cancel your order within 24 hours of placement if it has not yet been shipped Once an order has been shipped, our Returns and Refunds Policy applies We reserve the right to cancel orders at our discretion, including for pricing errors, product unavailability, or suspected fraud If we cancel your order, we will issue a full refund to your original payment method

Shipping and Delivery

We ship internationally to most countries Processing time: 3-5 business days Estimated delivery time: 7-14 business days (may vary by location) Shipping is handled by third-party carriers, and delivery times are estimates only We are not responsible for delays caused by customs, weather, carrier issues, or other circumstances beyond our control

Delivery

You are responsible for providing an accurate and complete shipping address If you provide an incorrect address, you must contact us immediately at info@officialvolna.com. Please note that delivery times may increase if address corrections are needed Risk of loss and title for products pass to you upon delivery to the carrier We are responsible for lost packages and will work with you to resolve the issue, which may include sending a replacement or issuing a refund

International Orders

International customers are responsible for understanding and complying with their country's import regulations You may be subject to import duties, taxes, and customs fees, which are your responsibility We are not responsible for delays caused by customs processing

OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Dispute Resolution and Governing Law

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Saskatchewan, Canada, without regard to its conflict of law provisions.

Informal Resolution

If you have any concerns or disputes, please contact us first at info@officialvolna.com. We will attempt to resolve the dispute informally.

Binding Arbitration

If we cannot resolve a dispute informally within 60 days, any dispute arising from or relating to these Terms or the Site shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration body in Saskatchewan, Canada, rather than in court.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and Returns and Refunds Policy, constitute the entire agreement between you and Volna regarding the use of the Site and Services.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

No Agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Volna.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

Survival

Provisions of these Terms that by their nature should survive termination (including but not limited to indemnification, limitation of liability, and dispute resolution) shall survive termination of these Terms.
